What Is Discrimination?

Discrimination is described as the failure to treat all persons equally where no reasonable distinction can be found between those favored and those who are not favored (Black's Law Dictionary).

In layman's terms, discrimination is the unfair treatment or denial of normal privileges of employment, such as benefits, working hours, pay increases, transfers, or similar because of race, age, sex, nationality, pregnancy, religion, marital or veteran status, or handicap whether physical or mental.

Discriminatory conduct is not discrimination. It is in all likelihood the creation of a hostile and abusive work environment and therefore, if the elements of Harris, (as previously cited in the Harassment section of this site) are met could be a violation of the standards that constitute harassment.
